Defendants in a civil RICO lawsuit will no longer be able to challenge their alleged connection to various companies accused of engaging in an outsourcing scheme after the defendants failed to provide required discovery, a federal judge has ruled in a sanctions dispute.
U.S. District Judge Jeffery L. Schmehl of the Eastern District of Pennsylvania determined that the defendants, Wieslaw Smulski and Michal Smulski, who are both from Poland, were "self-serving" and "calculating" in failing to fully respond to the court's discovery orders for emails and bank records.
