A Chester teacher dismissed for allegedly referring to his students as “idiots” is still eligible for unemployment compensation because his employer failed to prove he committed willful misconduct, the Commonwealth Court said Monday.

The Unemployment Compensation Board of Review issued an order in December 2020 affirming a referee’s decision finding the former teacher, David L. Rudnick, is eligible for employment compensation under Section 402(e) and said the Chester Community Charter School failed to prove his willful misconduct.
