As a result of COVID-19’s impact on the world as we knew it, employers and employees alike have demonstrated resourceful and creative ways to keep business going throughout the challenges of a global health emergency.

This article explores legal issues that are worth revisiting as employers navigate the shift toward hybrid or fully-remote work and the hot-button issues for employers to keep in mind to avoid unnecessary exposure. In some respects, the effects of the “great resignation” and changing preference for working from home have given employees an upper hand. In order to stay competitive in retaining employees and recruiting efforts, employers have had to review their policies and ability to accommodate employees, who, by choice or necessity, no longer fill the offices and cubicles. With this newfound flexibility, however, comes a warning to employers to revisit their policies and consider the legal implications of where your employees are working.
