On Dec. 5, 2018, plaintiff Sue Beckhold, 65, a pharmacy delivery person, was stopped behind a school bus on Walnut Bottom Road in Cumberland. The rear of her sedan was struck by the front of a Rabbit Transit bus. Beckhold claimed head injuries.

On Jan. 21, 2021, plaintiff Charles English, 50, a truck driver, was driving east on Interstate 80 in Luzerne County. The rear of his flatbed truck was struck by the front of a tractor-trailer driven by Christopher Childs, of Fraley & Schilling Inc. The accident occurred during an active snowstorm with ice on the roads. English claimed shoulder injuries.

In the recent case of Shell v. Shell, the Pennsylvania Superior Court addressed the issue of when a divorce litigant dies prior to a party filing an affidavit under 3301(d). In the Shell matter, a divorce action was instituted, and prior to either party filing an affidavit under Section 3301(d), the husband passed away.
