In February 2019, plaintiff Esther Purnell, 57, a Black female, was terminated from her position as school principal of Radnor Middle School. She claimed her termination was retaliatory. Purnell sued the Radnor Township School District. She alleged that the school district violated Title VII of the Civil Rights Act of 1964 and the Pennsylvania Human Relations Act.

University of North Carolina, US Supreme Court, No. 21-707, the most diverse Supreme Court in American history tackles nuanced issues of equal protection and race under the Fourteenth Amendment. A decision is expected in June 2023.

Earlier last year, the U.S. Court of Appeals for the Third Circuit in SodexoMAGIC v. Drexel University made this law—that the gist of the action doctrine does not bar a viable tort claim between two parties just because the parties papered the social duty giving rise to a tort claim into a contract—abundantly clear. Yet, many courts in Pennsylvania continue to misapply the doctrine.
