Summary judgment was not appropriate in action between building material manufacturer and wholesale building supply distributor alleging breach of contract and unjust enrichment because myriad issues of material fact regarding whether there was an oral agreement between the parties precluded summary judgment and the court found that a reasonable jury could find that if there was an oral agreement, it was an agreement for services, not the sale of goods, and was thus, not barred by the UCC statute of frauds. Motion denied.
