New SocGen private banking group to offer advice to legal professionals

Societe Generale Private Banking Hambros (SGPB Hambros) has launched a group to advise the legal sector with the hire of two private bankers. Mark Dean and Dominic Peyton, who joined SGPB Hambros at the end of last year as senior private bankers, will provide wealth management advice to lawyers in private practice and at the Bar. Prior to joining SGPB Hambros, Dean was a director at Citi Private Bank, acting as a client relationship manager to UK and international law firms based in London. Peyton was formerly a partner at Coutts & Co in the professional client group, managing a private banking team acting for clients including high-earning solicitors and barristers.

Herbert Smith private client tax partner joins BLP's London office

Berwin Leighton Paisner (BLP) has recruited Herbert Smith private client tax partner Rupert Ticehurst for the firm's City base. Ticehurst has joined BLP's London office as a partner in the the UK top 20 firm's tax department. He has been a partner at Herbert Smith since 2005 and headed the firm's private wealth and charities practice. He advises on tax and trusts, in particular legal disputes for families, individuals and charities for UK and international clients.

Offshore: In case of divorce

The recent decision of the UK Supreme Court in Radmacher (formerly Grantino) v Grantino has reversed the ruling of the Privy Council in MacLeod v MacLeod and cleared the way for prenuptial agreements to be made legally binding. The Privy Council is the court of final appeal for, among others, Bermuda, the British Virgin Islands (BVI) and the Cayman Islands. Its decisions are binding on the first instance and appeal courts of those jurisdictions. It is worth noting that many of the same judges sit in the Privy Council and in the Supreme Court. Two judges, Lady Hale and Lord Walker, were on the bench for both Radmacher and MacLeod.

Bircham Dyson appoints new private wealth head

Bircham Dyson Bell has appointed Helen Ratcliffe as its new head of private wealth, replacing James Johnston in the role. Ratcliffe joined Bircham Dyson in 2000 and made partner in 2002. She advises both UK and non-UK domiciled high net worth individuals on all aspects of their estate and tax planning. She also has experience of advising trustees and beneficiaries on all aspects of trusts in both the onshore and offshore context.

Private client: Where there's a will, there's a way

The world of wills and probate has recently become a battleground over whether writing a will should be a reserved legal activity. A reserved legal activity may only be carried out by regulated legal professionals such as solicitors and barristers. However, people who are not subject to any regulation at all may complete a great deal of legal advice and services including - to the vexation of the legal profession - the writing of wills. This has resulted in a whole industry of non-lawyer will writers fuelled by the fact that the majority of adults in the UK do not have a will, meaning that there is a significant underlying demand for their services. It is, of course, in the legal profession's interest that will writing becomes a reserved activity, but lawyers argue it is in the public's interest, too. Arguments have been advanced both for and against regulating, based on the need for consumer protection on one hand and the cost burden and effectiveness of regulation on the other.
