Despite Deripaska's claims that the case should be held in Russia, the court upheld a previous ruling that there could be risks to Cherney's safety and right to a fair trial in the $4 billion dispute if the case were held in Russia.

The Magic Circle firm confirmed that the claim -- made against the firm by Norman Schoenfeld in December -- was expected to close shortly.
