Unions' ability to enforce review of company outsourcing takes a blowThe ability of unions to enforce contract terms that allow review of company outsourcing decisions suffered a blow in the 7th U.S. Circuit Court of Appeals in a hard fought legal battle that included three arbitrations and three appeals. A dispute between Ameritech Corp. and the International Brotherhood of Electrical Workers, Local 21, in Illinois, centers on a contract provision that allowed the union to review any contracting out of company work that would cause layoffs or part-time work or prevent rehiring of employees with seniority. In addition, some of those potentially lost, outsourced jobs could be allotted to union workers.
