A judge in San Diego has granted a summary judgment motion to SkyWest Airlines Inc. in the first federal ruling to address whether California's strict wage and hour laws are pre-empted by the Airline Deregulation Act of 1978. In the ruling, the judge relied in part on a decision issued last year by the state's 2nd Appellate District for SkyWest against a class of California flight attendants alleging similar wage violations. In that ruling, the panel found that the Airline Deregulation Act pre-empted California's unfair business claims.
