The recent switch by the Trump administration's U.S. Justice Department from opposing to defending bans on class actions in workplace arbitration agreements will have consequences beyond a trio of challenges the U.S. Supreme Court is set to hear this fall. The government this week, citing the high court switch, said it will no longer defend a class action provision in the U.S. Labor Department's fiduciary rule.

Wife had not waived her claim to equitable distribution where husband had filed divorce action raising claim for equitable distribution, wife filed counter-affidavit indicating a claim for economic relief, and the parties entered a bifurcated divorce where trial court retained jurisdiction over economic claims that survived the divorce. Order of the trial court reversed.

Civic association's "bingo" game constituted lawful form of bingo where the game's mechanics involved a preset combination of spaces prior to patrons' purchase of bingo card and did not have predetermined winners, and where the Bingo Act contemplated a game where a "pre-announced combination" of spaces were used, in addition to the traditional conception of the game involving a wheel or mechanical device to choose numbers following the sale of cards. Order of the trial court affirmed.

Orphans' court's order threatening contemnor with possible incarceration for his refusal to make payments ordered by the court was consistent with its authority to compel obedience to a prior order and to compensate appellee for injuries sustained by appellant's chronic nonpayment and the sanctions were tailored to appellant's ability to comply and were strictly civil in nature. Affirmed.

In the 18 months that Daniel Arshack has represented a Bronx woman charged with murdering her husband, he has been adamant that notes taken by caseworkers who interviewed her children would prove crucial to her defense. Last week, the First Department recognized his client's rights to share them within the confines of the attorney-client relationship. But if the case were in the Second Department, he would not have been allowed to see them.
