Judging the judges

Recently I was asked to step outside my comfort zone of banging on about corporate law to speak at a panel debate about the rising political and constitutional role of the judiciary (I suggested they get someone better, but they asked twice). It was an interesting experience, not least because of the recent launch of the Supreme Court and the prospect of a Conservative Government overhauling constitutional statutes. Anyway, for what it's worth, below is the introductory speech I wrote for the debate, with a couple of tweaks for the written form.

The case involves coverage of a prominent University of Miami School of Law professor and civil rights advocate Donald Marvin Jones, who was arrested on suspicion of soliciting an undercover officer for sex.

Trespassing: Possession question

Some of the procedural difficulties encountered in claims for possession brought against trespassers were highlighted in the recent claim brought by Vestas Blades UK Ltd on the Isle of Wight to evict employees who had taken possession of the company's property in an act of protest. A 'trespassers' action can be brought under either an accelerated two stage procedure (Interim Possession Orders - CPR r.55 Pt.III) or by way of a summary claim (Pt.I of Rule 55). This article considers the latter approach - summary possession.

Long-serving Freshfields partner set to take new role at German boutique

Freshfields Bruckhaus Deringer is to lose one its longest-serving partners, with Hamburg-based Jan Willisch set to retire from the firm at the end of this month. The 57-year-old will remain in legal practice, taking up a new role as a partner at 21-lawyer Berlin firm Lindenpartners, which was formed in 2006 by former lawyers of Clifford Chance, Hengeler Mueller and Haarmann Hemmelrath. Willisch's arrival will boost partner headcount at the firm to eleven.
