The practice of law in Pennsylvania has been traditionally regulated by the Supreme Court of Pennsylvania. However, recent developments have called into question the presumption that only the court may regulate attorneys, suggesting that it is yielding at least some of that authority to the Pennsylvania legislature under certain circumstances.

Your first few weeks as a young attorney at a new job (in the public or private sector) will be a whirlwind of trainings, signing forms, meeting your fellow attorneys and potentially even getting that terrifying first assignment. It should also involve introductions to your nonattorney colleagues—assistants, paralegals, office managers, supply managers, etc. While it is obviously critical for you to produce an excellent work product and develop a good reputation for yourself among your fellow attorneys, it is equally critical—though too often overlooked—that you learn (and quickly) how to properly interact with and treat your nonattorney colleagues.

When the same individual hires an employee and shortly thereafter fires him, it makes intuitive sense that discrimination almost certainly did not motivate the termination. After all, why would an employer hire an employee in a protected category and then use the protected category as a factor in the subsequent termination? The U.S. Court of Appeals for the Third Circuit, however, has consistently rejected what is often referred to as the "same hire, same fire" defense, as precluding a finding of discriminatory animus, finding it to be simply "evidence like any other ... ." The most recent test of this defense was in the case of McMullin v. Evangelical Services for the Aging, No. 2:16-cv-06660 (E.D. Pa. Aug. 2).
