    Recruiter Seeks $1.3M From Baker Donelson Over Unpaid Merger Fee

    Philadelphia-based Abelson Legal Search claims that Baker, Donelson, Bearman, Caldwell & Berkowitz owes it $350,000 as a result of its combination last year with Baltimore's Ober Kaler. The suit filed in a federal court in Memphis also seeks $1 million in punitive damages.

    Patent Invalidated Based on Inequitable Conduct

    It's been called the atomic bomb of ­patent law—inequitable conduct. It happens when a patent is applied for, but the duty of candor, disclosure and good faith toward the U.S. Patent and Trademark Office (USPTO) is violated. If proven to have occurred during patent procurement, then the entire resulting patent becomes unenforceable. Even if inequitable conduct affects a very limited aspect of a patent application, the consequences are catastrophic as the ability to assert the resulting patent vanishes.

    It is no secret that building envelope construction defects are prominent throughout our region. This issue affects thousands of properties and multiple builders. These defects are truly latent, with no visual cues or outward manifestation of water infiltration. Homeowners often discover the defect when they see scaffolding at their neighbor's home and wonder if their home is similarly impacted. When invasive tests are finally performed, they often reveal a costly problem that in most cases requires removal and replacement of the entire building envelope, microbial growth remediation, window and door replacement as well as interior work.

    An investor group's federal lawsuit against Blank Rome, Cozen O'Connor and Cushman & Wakefield won't be stopped by Pennsylvania's statute of limitations, but claims brought by three of the plaintiffs, including British real estate tycoon Berish Berger, have been thrown out.

    Perjury at an Arbitration Hearing—Grounds to Vacate?

    The Federal Arbitration Act (FAA) permits a court to vacate an ­arbitration award "where the award was procured by corruption, fraud or undue means," 9 U.S.C. Section 10(a)(1). The Pennsylvania Uniform Arbitration Act says pretty much the same thing—a court can ­vacate an arbitration award if "fraud, misconduct, corruption or other irregularity caused the rendition of an unjust, inequitable or unconscionable award."
