The Supreme Court said Monday that it will consider whether an age discrimination lawsuit against FedEx Corp. can proceed. At issue is whether a group of 14 FedEx employees, led by Patricia Kennedy and Paul Holowecki, followed proper procedures in suing FedEx for age discrimination. The company is arguing that the suit should be dismissed because Kennedy did not file a formal charge alleging age discrimination with the Equal Employment Opportunity Commission until after she sued FedEx.

Federal Communications Commission general counsel Sam Feder last week issued an opinion freeing Republican commissioner Robert McDowell to vote on BellSouth's $80 billion merger with AT&T. If McDowell chooses to unrecuse himself from voting on the deal, his vote is expected to break a stalemate that has prevented the merger from winning final regulatory approval. McDowell voluntarily recused himself because of conflicts of interest between the vote and his previous position as a telecom industry lobbyist.
