Supreme Court justices reject Circuit City appeal in overtime arbitration case
WASHINGTON AP - The Supreme Court on Monday turned down an appeal by Circuit City Stores Inc. in an overtime-pay dispute that pits California state labor law against federal arbitration rules.At issue is whether state courts can refuse to enforce a federal arbitration agreement in disputes involving state employment laws.Kluczyk v. Tropicana Products, Inc. et al.
Where the termination occurred during litigation, and plaintiff alleged constructive and retaliatory discharge, the judgment in his favor on his retaliatory discharge claim is affirmed; there was at least a jury question as to whether plaintiff had resigned or quit before he received the letter of termination, as well as whether he was in fact terminated because he lied on his job application, and as the jury did not return inconsistent verdicts, there is no basis for disturbing the judgment.

Plaintiffs established that their lien had priority over appellant's two confessed judgments where appellant did not properly revive the judgments and thereby maintain their priority.
