On May 28, 2016, plaintiff Andre Phillips, 29, was charged with multiple firearm crimes after being arrested by police officer Alex Cricelli, in Philadelphia. Phillips claimed that he was innocent, and he was later exonerated of the charges in July 2019. He claimed that he suffered emotional distress from Cricelli's arrest and the subsequent criminal prosecution.
