Thanks to an interlocutory appeal by permission, the Pennsylvania Superior Court considered whether the relation back doctrine applies when a plaintiff timely filed an action on behalf of an estate but does not apply to be appointed the personal representative until after the statute of limitations has run.

On Oct. 17, 2017, plaintiff Ruth Corcino-Woodruff, 62, was driving on Old Lincoln Highway in Langhorne. She came to a stop at the intersection with Woodbourne Road. The rear of her sport utility vehicle was subsequently struck by the front of a trailing pickup truck driven by Margaret Miles. Corcino-Woodruff claimed neck injuries.

Over the past five years or so, the Pennsylvania Supreme Court has been issuing one decision after another, along with civil litigation rule changes, most, if not all of which, have greatly favored personal injury plaintiffs' causes. A couple of recent decisions by the Pennsylvania Supreme Court have tempered this sense of futility for some.

He stopped at a red light at the intersection with Springfield Road and was subsequently rear-ended by a trailing sport utility vehicle driven by Andrew Bennett. Metelo claimed neck, back and knee injuries.
