The Commonwealth Court has upheld an order from a workers' compensation judge Tuesday awarding a former Berks Area Regional Transportation Authority bus driver total disability benefits after she claimed to suffer from post-traumatic stress disorder due to two separate incidents when bullets struck the bus she was driving.

The state House of Representatives was set to return to session Monday, subject to an earlier recall by Speaker Bryan Cutler, R-Lancaster. The Pennsylvania Senate was scheduled to reconvene Tuesday, subject to earlier recall by President Pro Tempore Jake Corman, R-Centre.

With regard to settlements, particularly those reached prior to trial, an insurance company's liability for a settlement will follow its duty to defend. If the insurance carrier owes a duty to defend, and the settlement resolves that potentially covered liability, the settlement will be deemed covered under Pennsylvania law.

She claimed that the portion of the sidewalk was part of the property owned by Temple University, and the portion allegedly had undergone patchwork by Pasquale Portolese Inc. Broccolo suffered an elbow fracture.
