City firm Speechly Bircham has helped supermodel Elle Macpherson to secure victory in a court dispute involving liquidated bank Kaupthing Singer & Friedlander (KSF). Litigation & Regulatory Team of the Year

Herbert Smith wins Litigation and Regulatory Team of the Year thanks to its work securing British Sky Broadcasting (BSkyB) damages of at least £272m from EDS following the botched installation of a customer relationship management (CRM) system. The firm was originally instructed by BSkyB in 2002, shortly after EDS was removed from its role as systems integrator. The challenge was to overturn a liability cap arranged at the outset of the deal that limited EDS' liability for damages to a maximum of £30m.

Chambers of the Year

London set 3 Verulam Buildings (3VB) impressed the judges with its drive to promote new talent and be flexible in the way it delivers its services. The set offers fixed and capped fees and is willing to deploy conditional fees. "Inspired and reassuringly commercial," is how one client described the fee structures offered by the set. It also has an express commitment to encourage the use of junior counsel where appropriate. 3VB has been regarded as a leader in banking litigation for many years. Unsurprisingly, its advocates have featured in a host of high-profile credit crunch-related cases, including BPI v Barclays, UBS v HSH Nordbank and UBS v Proton Bank. In all, six members of chambers were instructed in the bank charges litigation, which culminated in a Supreme Court hearing.

Changes needed for third-party funding to flourish

A new report into third-party litigation funding by legal market research agency Jures and commissioned by Fox Williams, has concluded that there are four crucial areas for development if the industry is to survive and prosper. First, it needs a growing profile within the legal profession. The report identifies that the success or otherwise of third-party funding will depend upon the extent to which it is embraced by the legal profession. Second, it needs a growing profile within the financial community. While there has been plenty of discussion about third-party funding emerging as a new asset class, investors have yet to be convinced that it will provide the desired returns - even in today's depressed markets, in which many of the traditional forms of investment have failed to deliver.

Should justice be televised?

The head of Sky News has argued in a new Guardian article that justice must be televised as allowing TV cameras in court would help restore public faith in criminal proceedings. Sky news has been campaigning for TV cameras to be allowed in court for the past year. John Ryley argues that the upcoming prosecutions of five men accused of abusing the parliamentary expenses system should be televised as the judge in the case has said the matter is "of intense public interest". Televising proceedings would help restore the loss of confidence in parliament and politics and ensure that judges who are seen are 'out of touch' and 'liberal' need not escape the spotlight.

Supreme Court upholds right to comment defence in key libel case

The Supreme Court has overruled a lower court judgment that could have limited the use of right to comment defences, in the first major defamation case to be heard by the body. The Supreme Court unanimously overturned an earlier ruling from the Court of Appeal that blocked a booking agent that criticised a former client for "unprofessional" behaviour on its website from using a fair comment defence in libel proceedings.
