Unexpected Uses for China's New Antitrust Law

Peter Yuen, a Hong Kong partner at Freshfields Bruckhaus Deringer, has been tracking a number of cases in which individual Chinese lawyers, many of them active in consumer rights issues, have used an article of the new law to bring private actions against large Chinese companies, including China Mobile, Baidu and China Netcom. The proliferation of such cases may eventually require the Supreme People's Court to issue an interpretation of the country's new anti-monopoly law, he says.

Fried Frank Loses Another Top Antitrust Partner

On the heels of losing the head of its antitrust practice to a rival firm, Fried, Frank, Harris, Shriver & Jacobson is losing another top antitrust partner. The Justice Department on Tuesday named Deborah A. Garza deputy assistant attorney general for regulatory matters. China Trial of Rio Tinto Execs to Start Monday

The trial in China of four employees of Anglo-Australian mining giant Rio Tinto Group on bribery and trade secrets infringement charges is set to begin Monday. According to Reuters, the hearing on the bribery counts will be open, but the trade secrets counts will be heard in a closed proceeding; both will be held in Shanghai. A lawyer for Ge Minqiang, one of the Rio Tinto employees, confirmed to the news agency that the trial would start on March 22, but said he did not know how long the trial might last.
