The court denied defendant's omnibus pretrial motion which included a request for discovery and inspection of evidence as well as a petition for a writ of habeas corpus in all respects and ruled that the case would remain on the March 2024 criminal jury trial term.
Appellants appealed multiple rulings in action over LLC operating agreement and dissolution of the LLC and court found trial court properly found the 2012 OA remained in effect, appointment of a custodian was warranted and trial court properly approved custodian's recommendation to dissolve the LLC and license some of its assets. Defendant homeowners filed preliminary objections to a mechanics' lien claim filed by a construction contractor. The court overruled the preliminary objections, holding in pertinent part that plaintiff contractor presented a legally sufficient mechanics' lien claim through a quantum meruit cause of action even where plaintiff's general contractor agreement did not comply with the requirements of the Home Improvement Consumer Protection Act.
